The High Court Rules on KFCB Mandate over Classification of Advertisements

The High Court has dismissed a petition filed by beer companies challenging the Board’s order requiring beer manufacturers to take alcohol advertisements out of the watershed period.

The ruling follows a temporary injunction in January this year in which KFCB obtained orders restraining beer companies from airing beer adverts during the watershed period, and that all audio visual adverts should be submitted to the Board for classification.

The companies went to the Constitutional Court to challenge KFCB’s mandate, including companies such as Kenya Breweries Limited, African Spirits Limited, and Safaricom.

The court has ruled that KFCB has the mandate in the law to and that all adverts must be submitted to the Board for rating and classification.
